Terms of Service

These terms are an agreement between you and Kinetix AI LLC ("Kinetix", "we") for Kinetix Promo at kinetixpromo.com. By creating an account or using Kinetix Promo, you agree to them. If you use it for a company or a client, you agree for them and confirm you're allowed to. Our Privacy Policy and Refund Policy are part of these terms. The Kinetix music video service has its own terms.

1. Who can use Kinetix Promo

Kinetix Promo is for businesses and the people who market them, such as owners, staff, agents, agencies and freelancers. You must be 18 or older. Keep your email account secure: sign-in links and codes go there, and you're responsible for what happens in your Kinetix Promo account.

2. Plans and billing

• Free. 3 free videos, as watermarked 720p previews, with up to 3 rounds of versions each, and 2 GB for photos and clips. The free videos are once per person: a new account doesn't get them again if your email address, your browser or your network has already had them (our privacy policy says how we check). We may change what the free plan includes.
• Starter: $29 a month, 12 HD videos each billing month, 1 brand, and 10 GB for photos and clips.
• Pro: $79 a month, 30 HD videos each billing month, 1 brand, and 25 GB for photos and clips.
• Agency: $299 a month, 150 HD videos each billing month, up to 5 brands, and 100 GB for photos and clips.
• Done for you is arranged by email, under its own written agreement.

Prices are in US dollars. If we're required to collect sales tax, it's added at checkout and shown before you pay. Promotion codes, when offered, apply only as described when they're offered.

Your plan renews automatically every month, and Stripe charges your payment method at the start of each billing month, until you cancel. Cancel any time from Manage billing in the app. A cancelled plan runs to the end of the month you've paid for; then your account moves to the free plan and keeps your videos.

• HD videos are counted per billing month and don't carry over. If an HD video fails to render, it's given back.
• When you change plans, the change takes effect right away, and Stripe adjusts your next charge for the rest of the month.
• If a payment fails, Stripe tries again over the following days, and your plan keeps working meanwhile. If it still can't be paid, your plan ends and your account moves to the free plan.
• We'll email you at least 30 days before a new price applies to your plan, so you can cancel first if you'd like.
• To keep Kinetix Promo quick for everyone, there are daily limits on new videos and versions. The app tells you if you reach one.

Refunds are covered by our Refund Policy.

3. Your content

"Your content" means what you upload or type: photos, clips, logos, business details, scripts, reviews and other words. You keep all your rights to it. You let Kinetix store, copy, process and show it only to run Kinetix Promo for you: to make your scenes, previews, HD videos and captions, and to show them to you. That permission ends when you delete the content or your account, except for the copies our Privacy Policy describes.

You promise that:

• you own your content or have permission to use it this way;
• people who can be recognized in your photos and clips have agreed to appear in your marketing;
• reviews you use are real, from real customers, quoted exactly, and you're allowed to use them, without hiding anything you gave the reviewer in return;
• prices, offers, facts and claims in your videos are true, and you'll honor your offers.

4. Your videos and our music

The videos you make are yours to use: post them, run them as ads, and put them on your website, in emails or on screens in your business, anywhere and for as long as you like, including after you cancel.

Some parts of every video belong to Kinetix: the music (which our engine composes, so there's nothing to license from anyone else), the styles, looks, animations and templates. Kinetix gives you a worldwide, non-exclusive, royalty-free license, which never expires, to use those parts as part of your videos for any lawful purpose. You may not take them out of your videos to use on their own (for example, the music in another video), sell or license them separately, or register them with Content ID or a similar system. Other customers' videos may use the same styles and templates and similar music.

Free previews carry a watermark. You may post them, but don't remove or hide the watermark.

5. AI drafts and your responsibility

Claude, by Anthropic, writes the first draft of your scenes and labels your photos. We check every draft for facts that aren't in your profile, contact details in the lines, fair-housing phrases in real estate videos, and your words to avoid, but no check is perfect. Read every line before you post. You decide what to publish and are responsible for it, including following advertising and consumer protection rules, the rules of the platforms you post on, and for real estate agents, fair housing law and the rules on showing your license.

Templates are starting points, and the examples on our site use made-up businesses. We can't promise results such as views, bookings or sales.

6. Things you may not do

• break the law or anyone's rights, or make videos that are misleading, hateful, harassing, sexual or violent;
• pretend to be a business or person you don't represent;
• make fake reviews or testimonials, or present paid or invented endorsements as genuine;
• get around the limits (for example, with several free accounts), share your sign-in, scrape, overload, probe or reverse-engineer Kinetix Promo, or upload malicious files;
• use Kinetix Promo to build a competing product.

We may decline to make a video, remove content, or suspend or close an account that breaks these terms. Where we reasonably can, we'll tell you why first.

7. Ending

You can stop using Kinetix Promo at any time and delete your account in the app (cancel a paid plan first). We may close an account that breaks these terms. If we ever shut Kinetix Promo down, we'll give at least 30 days' notice and refund any time you've paid for and can't use.

8. Changes

We keep improving Kinetix Promo and may change or remove features. If we change these terms, we'll post them here with a new date, and if a change matters, we'll email you before it takes effect. If you keep using Kinetix Promo after that, the new terms apply.

9. Disclaimers

Kinetix Promo is provided "as is" and "as available". To the extent the law allows, Kinetix disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and doesn't promise that Kinetix Promo will be uninterrupted or error-free.

10. Limitation of liability

To the extent the law allows, Kinetix isn't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Kinetix's total liability for any claim about Kinetix Promo is limited to the greater of what you paid for Kinetix Promo in the 12 months before the claim, or $100.

11. If someone makes a claim about your content

If someone makes a claim against Kinetix because of your content or how you used your videos (for example, a photo you didn't have the right to use, or an offer you didn't honor), you'll cover Kinetix's reasonable costs of that claim, including legal fees.

12. Law and disputes

California law governs these terms, without regard to its conflict-of-law rules. Any dispute goes to the state or federal courts in San Diego County, California. Before going to court, please email us so we can try to sort it out.
